This website is operated by Freonwell through Freonwell.com. Throughout the site, the terms "Freonwell," "we," "us," and "our" refer to Freonwell.
These Terms of Service ("Terms") govern your access to and use of our website, online store, products, content, customer support, and related services (collectively, the "Services"). By visiting our website, creating an account, submitting information, or purchasing a product, you agree to these Terms and to the policies incorporated by reference.
Please read these Terms carefully before using the Services. If you do not agree, do not access or use the Services.
1. Eligibility and authority
You must be at least the age of majority in your place of residence and legally capable of entering into a binding agreement to use the Services or place an order.
If you use the Services on behalf of a company, employer, organization, or other person, you represent that you have authority to act for that party and bind it to these Terms.
2. Regulated refrigerant products
Certain products sold by Freonwell are regulated refrigerants. Federal, state, local, carrier, safety, and environmental requirements may apply to their sale, purchase, possession, transportation, use, recovery, resale, and disposal.
When required, refrigerant may be purchased only by:
- A properly certified technician purchasing refrigerant consistent with the appliances covered by the technician's certification.
- An employer of a properly certified technician or the employer's authorized representative, after providing acceptable proof of employment and certification.
- A wholesaler or reseller that provides documentation reasonably requested to verify lawful resale.
- Another purchaser who qualifies under an applicable legal exception.
Section 608 certification generally applies to refrigerants intended for stationary refrigeration and air-conditioning equipment. Section 609 certification generally applies to refrigerants intended for motor vehicle air-conditioning equipment. A Section 609 certification does not authorize the purchase of refrigerant intended for stationary equipment.
You agree to:
- Provide accurate, current, complete, and authentic certification, employment, authorization, business, or resale documentation.
- Purchase and use regulated products only as permitted by applicable law.
- Use trained and properly certified personnel when certification is required.
- Follow the product label, Safety Data Sheet, equipment manufacturer's instructions, and applicable safety and environmental requirements.
- Not vent, misuse, improperly transport, or improperly dispose of refrigerant or cylinders.
We may request additional documentation, verify submitted information, maintain required transaction records, place an order on hold, limit quantity, cancel an order, or refuse service when we cannot verify purchase eligibility or reasonably believe a transaction might violate applicable requirements.
3. Product selection and compatibility
You are responsible for confirming that the refrigerant type, cylinder size, valve or connection, application, equipment, oil, and other specifications are suitable for your intended use before ordering.
Website content, product descriptions, frequently asked questions, compatibility assistance, and customer support are provided for general informational purposes. They do not replace the equipment manufacturer's documentation, the product label, the Safety Data Sheet, applicable codes, or advice from a qualified HVAC or automotive professional.
Do not mix refrigerants, substitute a refrigerant without proper authorization and technical evaluation, or use a product in an incompatible system. Contact support@freonwell.com before ordering if you are uncertain.
4. Accounts and information
You may need to create an account or provide information to use certain Services. You agree to provide accurate and complete information and to keep it current.
You are responsible for safeguarding your account credentials and for activity conducted through your account. Notify us promptly if you suspect unauthorized access or use.
We may suspend or close an account that contains false information, is used without authorization, presents a security or fraud risk, or violates these Terms.
5. Orders and acceptance
An order submission is an offer to purchase and does not mean that we have accepted the order. An automated order confirmation only confirms that we received your order.
We may review, hold, limit, reject, or cancel an order for reasons including:
- Purchase-eligibility or certification requirements.
- Product availability or inventory errors.
- Pricing, description, or checkout errors.
- Payment authorization or fraud concerns.
- Quantity limits, suspected resale, or unusual purchasing activity.
- Shipping-address, carrier, hazardous-material, or destination restrictions.
- Suspected violation of law, these Terms, or another Freonwell policy.
If we cancel an order after payment has been authorized or collected, we will void the authorization or issue an appropriate refund to the original payment method. Payment-provider processing times may apply.
6. Prices, promotions, and taxes
Prices, discounts, promotions, availability, and product information may change without notice. The price and discount displayed at checkout when you submit the order will apply, subject to correction of obvious errors.
Promotions may have additional terms, eligibility requirements, quantity limits, expiration dates, or exclusions. Promotions cannot be combined unless expressly stated.
Applicable taxes, shipping charges, handling charges, and other required amounts are calculated or displayed at checkout. We do not represent that every transaction is tax-free. You are responsible for taxes and fees not collected by us when applicable law places that responsibility on you.
7. Payment
You authorize Freonwell and our payment providers to charge the payment method submitted for the order total, including applicable products, shipping, taxes, and fees.
You represent that you are authorized to use the payment method and that the billing information is accurate. We may require additional verification or cancel an order if payment cannot be authorized or reasonably appears fraudulent.
8. Shipping and delivery
Shipping is governed by our Shipping Policy, which is incorporated into these Terms.
Delivery dates are estimates and are not guaranteed. Carrier capacity, hazardous-material requirements, weather, holidays, address issues, remote-area service, regulatory reviews, and events outside our reasonable control may affect processing or delivery.
You are responsible for providing an accurate, complete, and eligible delivery address and for ensuring that an authorized person can receive the shipment when required.
9. Returns, refunds, and cancellations
Returns and refunds are governed by our Returns and Refunds Policy, which is incorporated into these Terms.
Refrigerant cylinders are regulated goods and must not be returned without prior written authorization and approved carrier instructions.
Cancellation requests are not guaranteed after an order enters processing or is handed to a carrier.
10. Safety
Refrigerant and pressurized cylinders can present serious safety hazards if mishandled. You agree to:
- Inspect the product, cylinder, valve, seal, label, and packaging before use.
- Not use, connect, transport, or attempt to repair a cylinder that appears damaged, leaking, altered, or unsafe.
- Keep cylinders upright, secured, protected from physical damage, and stored in a cool, dry, well-ventilated location away from heat, flame, and direct sunlight.
- Use appropriate recovery, charging, detection, protective, and service equipment.
- Follow all product, workplace, transportation, environmental, and disposal requirements.
If a cylinder appears to leak or presents an immediate danger, move away from the area, avoid ignition sources, follow the product Safety Data Sheet and instructions from the carrier or local authorities, and contact us when it is safe to do so.
11. Prohibited uses
You may not use the Services:
- For an unlawful, fraudulent, deceptive, abusive, or unauthorized purpose.
- To purchase, possess, transport, resell, use, vent, or dispose of regulated products unlawfully.
- To submit false certifications, forged documents, false claims, or misleading account or payment information.
- To violate intellectual-property, privacy, publicity, or other rights.
- To transmit malware, harmful code, spam, or automated requests that interfere with the Services.
- To scrape, copy, reproduce, reverse engineer, or exploit the Services or their content except as permitted by law or written authorization.
- To bypass security, fraud-prevention, purchase-eligibility, quantity, geographic, or technical restrictions.
12. Intellectual property
The Services and their content—including text, graphics, logos, photographs, product presentations, layouts, software, and other materials—are owned by Freonwell or used with permission and are protected by applicable intellectual-property laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal or internal business purchasing purposes. No other right or license is granted.
13. Reviews and other submissions
If you submit a review, photo, feedback, suggestion, or other content, you represent that you have the right to provide it and that it is accurate, lawful, and does not violate another person's rights.
You grant Freonwell a worldwide, non-exclusive, royalty-free license to host, reproduce, modify for formatting, publish, display, and use the submitted content in connection with the Services and our business, subject to applicable law and our Privacy Policy.
We may remove or decline content that is unlawful, misleading, abusive, irrelevant, contains personal information, or violates these Terms.
14. Third-party services and links
The Services may use or link to third-party platforms, payment providers, carriers, applications, websites, or other services. We do not control third-party services and are not responsible for their content, availability, security, policies, or conduct.
Your use of a third-party service may be governed by separate terms and privacy policies.
15. Privacy
Our collection and use of personal information is described in our Privacy Policy.
16. Disclaimer of warranties
To the fullest extent permitted by applicable law, the Services and website content are provided on an "as is" and "as available" basis. We do not warrant that the website will be uninterrupted, error-free, secure, or that all content will always be complete, current, or suitable for every application.
Product warranties, if any, are limited to the warranties expressly provided with the product or required by law. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
17. Limitation of liability
To the fullest extent permitted by applicable law, Freonwell and our owners, personnel, affiliates, service providers, and representatives will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost revenue, lost data, business interruption, or substitute purchases, arising from or related to the Services, products, or these Terms.
To the fullest extent permitted by law, our aggregate liability arising from a specific order will not exceed the amount you paid to Freonwell for the product giving rise to the claim.
These limitations do not apply where prohibited by law or to liability that cannot lawfully be limited.
18. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Freonwell and our owners, personnel, affiliates, service providers, and representatives from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the Services or products, your violation of these Terms, your false or unauthorized submissions, or your violation of another person's rights.
19. Suspension and termination
We may suspend or terminate access to the Services, cancel an account, or refuse future orders when reasonably necessary to address fraud, safety, legal, payment, security, eligibility, abuse, or policy concerns.
Provisions that by their nature should survive termination—including payment obligations, intellectual property, disclaimers, liability limitations, indemnification, and dispute provisions—will survive.
20. Changes to the Services or Terms
We may update the Services and these Terms from time to time. Updated Terms will be posted on this page with a revised "Last updated" date.
Your continued use of the Services after updated Terms take effect constitutes acceptance to the extent permitted by law. If required, we will provide additional notice of material changes.
21. Governing law and disputes
These Terms are governed by the laws applicable to Freonwell's operation and the relevant transaction, without giving effect to conflict-of-law principles, except where mandatory consumer laws require otherwise.
Before filing a formal claim, please contact support@freonwell.com and provide a description of the dispute, the relevant order number, and the resolution requested so the parties can attempt to resolve the matter informally.
22. General provisions
If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.
Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a merger, reorganization, financing, asset transfer, or similar business transaction.
These Terms and the policies referenced in them constitute the entire agreement between you and Freonwell concerning the Services and supersede prior communications concerning the same subject.
